Public Employee Faces Compensation Claim Fraud Charges
Insurance company Intercare Insurance Services alleges that Emily Kathleen Everett, a former employee, attempted to win a compensation claim by falsifying statements and illegally receiving disability benefits. In 2007, when Everett was employed by the state of California as a hospital health care worker she reported that she was injured on the job. She submitted an accident report and received follow up care that indicated that several sprains prevented her from performing her job duties. It was when Intercare Insurance Services, her employer’s insurance provider, began to investigate that they found Everett had participated in marathons and other athletic competitions while she was on disability.
Following this discovery, Intercare Insurance Services also found that Everett made false statements to an orthopedic surgeon and came to her doctors visits while using a cane. While Ms. Everett continued to collect benefits she began to consult with several California attorneys on the pretense of filing a lawsuit against her employer, Laguna Hospital. At the conclusion of Intercare Insurance Services’ investigation they found that Everett, a health care worker who is well experienced with how compensation claims work, attempted to defraud both their company and their client as well as the state of California. Intercare Insurance Services contacted the California Department of Insurance, who in turn contacted law enforcement agents. After a warrant was issued for Emily Everett’s arrest she turned herself in without incident and was booked on several charges including grand theft and perjury. If found guilty, Everett will be required to pay back the $9,500 in disability benefits collected while defrauding the state as well as restitution. Everett may also face jail time if it is found that she advised others on how to make false compensation claims. Everett was arrested before she had the opportunity to official file a lawsuit against Laguna Hospital.
